Brookings India hosted a Tiffin Talk on “Impact of Litigations in the Real Estate Market in Mumbai” with Sahil Gandhi, Assistant Professor, Tata Institute of Social Sciences.

Abstract: The formal housing market in Indian cities has not been responsive to the growth in urban population. Some of the striking features of land and real estate markets in urban India are unclear titles, encroachment and complex regulatory processes, which increase the likelihood of legal disputes and constraint the supply of housing. Sahil Gandhi finds that amongst ongoing real estate projects in Mumbai 30% of the development is under litigation and on average construction takes around 8.5 years to complete. He also finds that litigations have a statistically significant effect on estimated completion times of projects and that litigated projects take 20-28% longer to complete. He also carries out a qualitative examination of cases in High Court to understand the nature of litigations in real estate in Mumbai.

Speaker Profile: Sahil Gandhi is an Assistant Professor at Tata Institute of Social Sciences, where he teaches urban economics and other courses. He was formerly a Fellow at ICRIER, New Delhi. His research interests are in the areas of urbanisation in India, land and housing markets, and institutional economics. His research has been published as chapters in edited books, and as academic articles in Cities, Environment and Urbanization, Environment and Urbanization Asia, Public Finance and Management, India Review and Economic and Political Weekly. He has a PhD in Economics from University of Mumbai.
